Agreement *

This agreement constitutes an order for photography services, including the taking of pictures agreed to by both parties: Photographer (Enabeld and Client. Unless otherwise specified in writing signed by both Client and Photographer, it is understood that any and all rights to proofs, final, edited, or sample images, thereof shall remain the property of the photographer and may be used for advertising, display or any other purpose thought proper. The client is granted commercial use and personal printing and usage rights to images in social media, as attachments in emails to others and personal websites. Client will receive a digital download of edited images within 30 days of the photo session. Enabeld grants the Client permission to share the images on social networking websites, with family and friends, and on vendor websites. If Photographer cannot perform this Agreement in whole or in part due to a fire or other casualty, acts of God or nature or terror, or other cause beyond the reasonable control of the parties or due to Photographer's illness or injury, then the photographer will return all fees to the Client(s) but shall have no further liability with respect to this Agreement. This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera malfunction, lost in the mail, or otherwise lost or damaged without fault on the part of Photographer. Client(s) agrees to limit the photographer’s liability to the amount paid under this contract and in no event shall Photographer be liable for incidental or consequential damages. The service fee is $195 and includes 35 minutes of photography service and an online gallery for 1 week to download edited images. No photography will take place and no rights are granted until timely payment is made in full and late payment fees may apply. Upon signing of this agreement, the Photographer will reserve the time agreed upon for the photography session and will not make another reservation for the specific time frame. Cancellation must take place within 1 week of the session or extra fees may apply. A deposit of $50 is due after submitting this reservation. The balance of $145 is due 30 days before the session date. Extra hours are $100, any extra time will be charged accordingly. This Agreement constitutes the entire agreement of the parties relating to the subject matter addressed in this Agreement. This Agreement supersedes all prior communications, contracts, or agreements between the parties with respect to the subject matter addressed in this Agreement, whether oral or written. I /we, the undersigned Contracting Party, hereby warrant that I am / we are competent to contract in my / our own name(s). I/we confirm that I/we have read the herein agreement prior to its execution and I/we are fully familiar with the contents thereof. Check the box below if you accept the Agreement.
